Terms of service.

These Terms of Service (“Terms”) govern the agreement between you (“Client”) and DGX Aerial, LLC (“Company,” “we,” “us,” or “our”) for the provision of drone photography and videography services. By booking our services, you agree to be bound by the following terms:

1. Services

DGX Aerial provides a range of aerial photography and videography services, including but not limited to:

  • Event Coverage

  • Real Estate Photography/Videography

  • Construction Site Monitoring

  • Surveying

  • Virtual Tours

Specific details and pricing for each service will be outlined in the contract or invoice provided for each project.

2. Payment Terms

A 25% non-refundable deposit is required to secure your booking. The remaining balance is due upon completion of the project and delivery of final assets. We accept payments via credit card, debit card, and ACH transfers.

Failure to pay the final balance within 14 days of receiving the invoice may result in late fees or withholding of final assets until payment is received.

3. Rescheduling and Cancellations

  • You may reschedule your project up to two times for free if done 7 or more days in advance of the scheduled shoot.

  • Rescheduling requests made within 7 days of the scheduled date may incur additional fees.

  • Cancellations will result in the forfeiture of your 25% deposit. If you wish to cancel, please notify us in writing as soon as possible.

4. Project Delivery

The standard turnaround time for delivery of final photos or videos is 3 days following the project date. Any requests for expedited delivery may incur additional fees and should be discussed prior to the shoot.

All assets will be delivered digitally, unless otherwise agreed upon in writing.

5. Ownership and Usage of Deliverables

Upon receipt of final payment, you will receive a non-exclusive, perpetual license to use the photos and videos for personal or commercial purposes, as outlined in the specific agreement for the project.

DGX Aerial retains the right to use any media for promotional purposes, including social media, website, or portfolio, unless otherwise agreed upon in writing.

6. Insurance

We carry insurance to cover potential risks associated with drone operations. Specific policy details are available upon request.

7. Compliance and Safety

DGX Aerial operates in full compliance with FAA Part 107 regulations. We will obtain any necessary FAA waivers or airspace authorizations required for the project. However, it is the Client's responsibility to ensure that all other necessary permits, permissions, and access to the project site are obtained prior to the shoot. Any delays caused by lack of permissions or access may result in additional fees.

We reserve the right to postpone or cancel a shoot if safety conditions, weather, or legal restrictions prevent safe or lawful operation of the drone.

8. Liability

While we take all necessary precautions to ensure safety during our operations, DGX Aerial is not liable for any damages or losses resulting from the Client's failure to comply with these Terms, negligence, or unforeseen events beyond our control.

9. Force Majeure

In the event that DGX Aerial is unable to perform its services due to circumstances beyond its control (e.g., weather conditions, equipment failure, natural disasters), we will work with you to reschedule the project at no additional cost. However, DGX Aerial is not responsible for any financial losses incurred due to such events.

10. Governing Law

These Terms and any disputes arising from them will be governed by the laws of the State of Florida, without regard to its conflict of laws principles.

11. Modifications

DGX Aerial reserves the right to modify these Terms at any time. Any changes will be communicated to Clients and will apply to future projects and bookings.
